Article 1 — Provider Identification

These Subscription Terms govern subscriptions to SaaS services offered under the DwellingVerify brand.

Article 2 — Definitions

  • "Client" means any person or entity that has subscribed to the Services.
  • "User" means any person authorized by the Client to access the Services.
  • "Services" means the DwellingVerify platform, its features, interfaces, APIs, documentation and support services.
  • "Account" means the account created to access the Services.
  • "Client Data" means data, files, content or information transmitted or imported by the Client.
  • "Subprocessor" means any provider to whom the Provider entrusts part of the processing.

Article 3 — Purpose

These terms define the conditions under which the Provider supplies a remotely accessible SaaS service. Available features, limitations, quotas and restrictions correspond to the subscribed plan.

Article 4 — Acceptance

Subscribing implies acceptance of these terms. The Client must be able to review and retain a copy. For consumers, mandatory provisions of applicable law prevail.

Article 5 — Subscription

Subscription follows the process on the site. The Client warrants that information provided is accurate, complete and current. The Client is responsible for access granted to Users.

Article 6 — Subscriptions

Services may be offered as monthly, annual or other subscriptions. Unless stated otherwise, subscriptions auto-renew. The Client may disable auto-renewal. Cancellation does not end the already paid period.

Article 7 — Pricing

Applicable prices are those displayed at subscription time, in USD or other offered currencies. Applicable taxes may be added. The Provider may modify prices for future periods.

Article 8 — Payment

Payments are processed by Paddle as Merchant of Record. The Provider does not request full card details. Failed payments may be retried. Without resolution, access may be suspended.

Article 9 — License

Subject to payment, the Provider grants a personal, limited, non-exclusive, non-transferable right to use the Services. The Client may not:

  • Resell or sublicense the Services
  • Circumvent technical limitations
  • Attempt to obtain source code
  • Reverse engineer beyond legal limits
  • Use the Services to compromise security
  • Use the Services for illegal purposes

Article 10 — Client Data

The Client retains rights over Client Data. The Client authorizes the Provider to host, store, transmit and process data as necessary. When data contains personal data, the DPA applies.

Article 11 — Client Obligations

  • Use Services in compliance with applicable laws
  • Maintain credential confidentiality
  • Report any unauthorized use
  • Not introduce malicious code
  • Respect third-party rights
  • Hold necessary authorizations for transmitted data

Article 12 — Availability

The Provider uses reasonable means to ensure availability. Target: 90%. Exclusions: planned maintenance, security emergencies, third-party providers, Client network, force majeure.

Article 13 — Support

Support provided per subscribed plan. Email: action@projectsandgo.com. Response times are targets.

Article 14 — AI

When Services use AI, features are identified. Results may contain errors. The Client must verify before use. Results do not constitute professional advice.

Article 15 — Intellectual Property

The Provider retains all rights to the platform, software, interfaces, databases, documentation, trademarks and graphics. No IP transfer occurs through subscription.

Article 16 — Confidentiality

Each party preserves confidentiality of received information. Exceptions for public, legitimately known information or legally required disclosure.

  • Communication encryption
  • Access controls
  • Enhanced authentication
  • Backups
  • Logging
  • Vulnerability management
  • System monitoring

Article 18 — Termination

The Client may end renewal. The Provider may suspend or terminate for non-payment, material breach, illegal use, or security risk. Prior notice given when possible.

Article 19 — Post-Termination Data

Export period after termination: 1 day. Data may be deleted after, subject to legal obligations. Maximum deletion delay: 1 day.

Article 20 — Liability

Cumulative liability capped at amounts paid in the preceding 12 months. No limitation where prohibited by law. Consumer rights preserved.

Article 21 — Modifications

The Provider may evolve Services. Material changes communicated. Applicable termination rights remain.

Article 22 — Applicable Law

For professionals: Wyoming law, USA. For consumers: choice of law does not deprive of mandatory protections.
